1. PURPOSE AND GENERAL CONSIDERATIONS
1.1. Mog and Marley is the owner of the website www.mogandmarley.com which is a web platform through which products are sold.
1.2. The General Terms and Conditions described below regulates the conditions of use and access to the E-Commerce Site by all visitor and the buying of products offered by Mog and Marley on the E-Commerce Site.
1.3. Mog and Marley operates and delivers throughout the Philippine territory covering the entire Metro Manila and other nearby provinces via shipping.
2. ACCEPTANCE, MODIFICATION AND DURATION OF THE GENERAL CONDITIONS
2.1. The use and access of the E-Commerce Site by the User constitutes acceptance of these General Conditions. In addition, to be able to purchase any of the Products offered by Mog and Marley, it is compulsory for Users to complete a form with the identification details. If the User has any doubt regarding the General Conditions, they can contact the Company using the Identification details mentioned in the General Conditions.
2.2. General Terms and Conditions can be modified by Mog and Marley at any time.
3. OBLIGATIONS OF MOG AND MARLEY AND OF THE CUSTOMER/USER
3.1. Mog and Marley agrees to make available all of the necessary information to the Customer and/or User regarding the Products it offers as well as the orders which have been formalized. Mog and Marley accepts no responsibility for the temporary non-compliance of these General Conditions in the event of force majeure and in the event of a customer fault or an unforeseen event attributable to a third party.
3.2. The Customer agrees to complete the order forms, and any other forms necessary, truthfully and according to the instructions provided. The Customer also agrees to pay the price of the Product with the applicable taxes and delivery costs, always in accordance with the Final Statement of Account from Mog and Marley.
3.3. We recommend you review the information relating to the purchased Products. Mog and Marley accept no responsibility for the consequences and damages caused by the loss of the information caused by the Customer while accessing the site.
3.4. Mog and Marley accepts no responsibility for the consequences and damages that may result from the improper use of Products sold through the E-Commerce Site.
4. PRODUCT INFORMATION AND DESCRIPTION.
4.1. Mog and Marley has a detailed description of the Products included on the E-Commerce Site under the technical descriptions originating from distributors, manufacturers and suppliers in general. It also includes other information such as brand names, photographs or illustrations that, and therefore, Mog and Marley accepts no responsibility for any errors that may be derived from this.
4.2. The Site also contain a detailed information of the products, including their number of units available, price, and other further information about it.
5. PLACING AN ORDER.
5.1. By completing and submitting an electronic order form, you are making an offer to purchase goods in which, if accepted by us, will result in a binding contract. Please note that products will not be sent (or links to online products) until we have authorization from your payment card issuer. We will not be liable if there is a delay, and we will not accept your order if payment is not authorized.
5.2. After you have placed your order, you will receive an email to acknowledge your order. It will confirm which products you have ordered, but it may not constitute an acceptance of your order.
5.3. We do not have to accept your order, and for example, we will not accept your order if:
    • We do not have the products in stock  
    • Your payment is not authorized
    • There is an error on our website regarding the price or other details of the products
    • You have canceled your order
5.4. We reserve the right to refuse any order.
6. CANCELLATION, RETURNS AND REPLACEMENTS.
Cancellations are accepted as long as the orders are not yet processed. Returns and Replacements will not be accepted. Kindly review your orders before finalizing at the site and check the items before signing acknowledgement form.
7. AVAILABILITY
Products are subject to availability. In case that the Products are not in stock the customers will be informed.
8. PRICES
8.1. Delivery charge will incur in case the customer fails to meet the MOQ required. The total cost including delivery charge, which will be shown to the Customer before finalizing of order.
9. PRODUCT PAYMENT
9.1. Mog and Marley offers the following payment methods to Customers:
    • Bank Deposit / Bank Transfer
    • Debit/Credit Card
    • Gcash
9.2. After finalizing the orders and receiving proper authentication from the banks, the Customer will receive and online Billing Statement or Acknowledgement receipt together with delivery information.
10. SHIPPING FEE
Customers will be responsible for their own shipping costs per orders. Please send us a message or call to know the delivery rates.
11. PRODUCT DELIVERY
11.1. Mog and Marley will deliver the Products at the delivery address provided by the Customer, which must be within the limits of the Territory.
11.2. The date of delivery will be indicated on the Delivery Receipt.
11.3. The Customer agrees that he/she or another designated person will be at the address indicated to receive the order. In the event of not being present on the first occasion, the Mog and Marley will arrange a re schedule of delivery with certain amount of fees to be borne by the Customer.
12. PRODUCT GUARANTEE
12.1. All of the Products offered by Mog and Marley are guaranteed to be in good condition. If any of the Products contains a manufacturing defect, we agree to replace them with a new one. In this case, all of the Product return costs and sending of the new Product or the same product are borne by Mog and Marley.
12.2. Upon delivery make sure to check the item, once the Customer received the item and signed the Delivery Receipt, the Customer acknowledges that the products are in good condition.
12.3. The customer must inform Mog and Marley immediately with regards the products defects.
12.4. The guarantee does not include products damaged due to improper storing, tearing of packaging etc.
